Troopr privacy policy

Troopr Labs, Inc. ("Troopr", "us", "we", or "our") operates the Troopr and Enjo applications (the "Service"). This Policy applies to our Services and explains the following:

-What information we gather from you when you use the Service
-How we may use and share this information
-The security approaches we use to protect your information​

We will not use or share your personal information with anyone except as described in this Privacy Policy. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of service.

Account terms

  1. When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
  2. You may not use as a username or email address the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.
  3. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  4. You are responsible for all content posted and activity that occurs under your account. That includes content posted by others who either: (a) have access to your login credentials; or (b) have their own logins under your account.
  5. You may not use the Service for any illegal purpose or to violate any laws in your jurisdiction
  6. You must be a human. Accounts registered by “bots” or other automated methods are not permitted. You must be 18 years or older to use this Service.

Payment

  1. If you are using a free version of one of our Services, we do not ask you for your credit card.
  2. For paid Services that offer a free trial, after the trial period, you need to pay in advance to keep using the Service. If you do not pay, we will freeze your account and it will be inaccessible until you make payment. If your account has been frozen for a while, we will queue it up for auto-cancellation.
  3. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties, excluding only United States (federal or state) taxes.

Cancellation and Termination

  1. You are solely responsible for properly canceling your account. An email or phone request to cancel your account is not automatically considered cancellation. If you need help cancelling your account, you can always contact our Support team hello@troopr.io.
  2. All of your data will be immediately be inaccessible from the Service upon cancellation.
  3. We’ll permanently delete your account data within 30 days from our servers. Data can’t be recovered once it has been permanently deleted.
  4. If you cancel the Service before the end of your current paid up month, your cancellation will take effect immediately, and you will not be charged again. We do not automatically prorate unused time in the last billing cycle.
  5. We have the right to suspend or terminate your account and refuse any and all current or future use of our Services for any reason at any time. Suspension means you and any other users on your account will not be able to access the account or any content in the account. Termination will furthermore result in the deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. We also reserve the right to refuse the use of the Services to anyone for any reason at any time.
  6. Verbal, physical, written or other abuse (including threats of abuse or retribution) of our employee or officer will result in immediate account termination.
  7. We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. Of course, we’ll reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.
  8. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
  9. Verbal, physical, written or other abuse (including threats of abuse or retribution) of our employee or officer will result in immediate account termination.

Modifications to the Service and Prices

  1. Prices of all Services are subject to change upon notice from us. Such notice may be provided at any time by posting the changes to the site or the Service itself.
  2. We reserves the right at any time to modify or discontinue, temporarily or permanently, any part of the Service with or without notice.
  3. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of Troopr Labs, Inc and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Troopr Labs, Inc.

Data and Content

  1. Our Service allows you to post, link, store, share and otherwise make available certain information, data, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
  2. You represent and warrant that: (i) the Content is yours (you own it) or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
  3. By posting Content to the Service, you grant us the right and license to use, modify, perform, display, reproduce, and distribute such Content on and through the Service privately to you. You retain any and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.
  4. We claim no intellectual property rights over the material you provide to the Services. All materials uploaded remain yours.
  5. We do not pre-screen content, but reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Service.
  6. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission from us.
  7. You must not modify another website so as to falsely imply that it is associated with the Services or the Company.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Troopr Labs, Inc.

Troopr Labs, Inc has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Troopr Labs, Inc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Indemnification

You agree to defend, indemnify and hold harmless Troopr Labs, Inc and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

Limitation Of Liability

In no event shall Troopr Labs, Inc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Troopr Labs, Inc its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions. We are subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We may revise these Terms from time to time and at our sole discretion. When such changes are effected, we will publish an updated version on this page. The changes will become effective and will be deemed accepted by you, (a) immediately for those who register for the Service after the updated version is published on our website, or (b) for those having pre-existing accounts, the updated Terms will be deemed effective with your continued use of the Service.

If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Information We Collect and Use

Information You Provide: You provide us information about yourself, such as your name and e-mail address when you register for an account with the Service or by connecting with the Service via a third-party service. We receive and store the information you input when registering for our Service, or which you otherwise provide to us in any other manner. We may use your email address to send you Service-related notices. If you do not want to receive these messages, you can opt out by following the instructions in the message.

Payment Information: If you sign-up for a free trial account, you are not required to enter your credit card information unless and until you decide to continue with a paid subscription to our Services. A third-party intermediary is used to manage credit card processing. Your credit card is passed directly to our payment processor and doesn’t ever go through our servers.​

Content: You also provide us Content you post to the Service, or is otherwise collected through your use of the Service. Your Content and metadata about your Content may be viewed by other users in accordance with your settings on the Service. Unless Content is made viewable in accordance with your settings on the Service, then neither Troopr, Troopr employees, Troopr contractors nor agents will view your Content except: (i) to maintain, provide or improve the Service; (ii) to help you and respond to your request related to your Content, including support requests; (iii) to review and monitor (if we elect to do so) compliance with our Terms of Service (iv) to comply with or avoid the violation of applicable law or regulation or to cooperate with law enforcement; or (v) as otherwise described in this Privacy Policy. We have the right to remove any information you post, if deemed to be in violation of our Terms of service.

Cookies: When you use the Service, we may send one or more “cookies” – a small data file – to your computer to uniquely identify your browser and let us help you log in faster and enhance your navigation through our Service. A cookie may convey anonymous information about how you browse the Service to us. A persistent cookie remains on your hard drive after you close your browser so that it can be used by your browser on subsequent visits to the Service. Persistent cookies can be removed by following your web browser’s directions. A session cookie is temporary and disappears after you close your browser. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent; however, some features of the Service may not function properly if the ability to accept cookies is disabled.

Usage Data: When you use the Service, our servers automatically record certain information sent by your web browser. These server logs may include information such as your web request, Internet Protocol (“IP”) address, browser type, referring / exit pages and URLs, number of clicks and how you interact with links on the Service, domain names, landing pages, pages viewed, mobile carrier, and other such information.

Third Party Tools: We use third party tools for customer support and analytics, such as, yet not limited to Drift and Google Analytics, to help understand use of the Service. Many of these tools collect the information as sent by your browser as part of a web page request, including cookies and your IP address. These tools also receive this information and their use of it is governed by their privacy policy and opt out provisions, where applicable..

Do Not Track: If you enable or send a “do not track” signal or similar mechanism relating to the tracking of browsing activities, we do not have practices or protocols to honor or respond to such a request. However, we only collect the types of information otherwise described in this Policy.

How We Share Your Information

Service Providers, Business Partners, and Others: We may share information about you with other third parties (such as service providers who host our Service or otherwise support the operation of the Service) but we are not in the business of selling information about you to advertisers or third parties. If we do this, such third parties’ use of your information will be under instruction from us and bound by terms which are substantially similar to this Privacy Policy as applicable to the services which they are providing for us. If we receive personal data subject to our certification under the Privacy Shield and then transfer it to a third-party service provider acting as an agent on our behalf, we have certain liability under the Privacy Shield if both (i) the agent processes the personal data in a manner inconsistent with the Privacy Shield and (ii) we are responsible for the event giving rise to the misuse.

Compliance with Laws and Law Enforcement Requests: Protection of Troopr's Rights: We may disclose your personal information if required to do so by law or subpoena or if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect our rights or property.

How We Protect Your Information

The security of your information is important to us. To that end, we comply with industry-standard best practices to secure your personal information. We’ve also adopted commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your information. For example, we regularly back up your data to help prevent data loss and aid in data recovery. We also guard against common web attack vectors, host data in secure SOC 1, SOC 2, ISO 27001 and ISO 9001 compliant data center facilities, and implement industry standard firewalls and access restrictions on our servers to secure our network. No method of electronic transmission or storage is 100% secure, however, and we cannot ensure or warrant the absolute security of any information you transmit or store in the Service.

How We Retain Your Information

We generally discard information about you when it's no longer needed for the purposes for which we collect and use it, as described in the section above, and we're not legally required to keep it. For example, we retain your User Information until you delete your user account. However, some of your User Account Information may be retained after your account is deleted or deactivated as needed to allow your team members or other users in your company workspace to make full use of the Services. If you have elected to receive marketing emails from us, we retain information about your marketing preferences unless you specifically ask us to delete it. We retain information derived from cookies and other tracking technologies for a reasonable period from the date such information was created.

At the end of a retention period, we will either delete or anonymize the Personal Information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible. We reserve the right to retain certain Personal Information for longer periods if necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations and to continue to develop and improve our Services.

Your Choices About Your Information

We do not permit personal information to be used for reasons other than those for which it was originally provided. If this practice should change in the future, we will update this policy accordingly and provide individuals with opt-out or opt-in choice as appropriate.

You may, of course, decline to submit personal information through the Service, in which case we may not be able to provide certain services to you. You may update or correct your account information at any time by logging in to your account.

​It is your right to request, subject to certain limitations under applicable law, that your personal information be erased from our possession. Fulfillment of some data deletion requests may prevent you from using Troopr services because our applications may then no longer work. In such cases, a data deletion request may result in closing your account.

Children’s Privacy

Our Service is not directed to persons under 13, and we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the Service. If we become aware that we have collected personal information from a child under age 13 without verification of parental consent, we take steps to remove that information. EU-U.S. Privacy Shield

We comply with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. n compliance with the Privacy Shield Principles, we commit to resolve complaints about our collection or use of personal information. EU and Swiss individuals with inquiries or complaints relative to our data collection should first contact us at privacy@troopr.io.

We have further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit https://www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint. The services of JAMS are provided at no cost to you.

Under certain conditions, Privacy Shield provides the right to invoke binding arbitration when other dispute resolution procedures have not provided resolution. This is described in Annex I to the Privacy Shield.

European Union Data Subject Rights

If you are a resident of the European Union ("EU"), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the "GDPR") with respect to your Personal Data. Troopr is committed to ensuring compliance with the GDPR and protecting your rights as a data subject.

1. Right to Access: You have the right to request access to your Personal Data held by Troopr. We will provide you with a copy of the information we hold about you upon request, subject to verification of your identity.

2. Right to Rectification: You have the right to request the correction of inaccurate or incomplete Personal Data we hold about you. If your information changes, or if you believe that the information we hold is inaccurate, please contact us to update your information.

3. Right to Erasure (Right to be Forgotten): Under certain circumstances, you have the right to request the deletion of your Personal Data. Troopr will comply with such requests, subject to our legal obligations to retain certain information and data.

4. Right to Data Portability: You have the right to receive your Personal Data, which you have provided to Troopr, in a structured, commonly used, and machine-readable format and have the right to transmit it to another controller.

5. Right to Object: You have the right to object to the processing of your Personal Data for certain purposes, including direct marketing. You may also have the right to object when we are processing your data based on our legitimate interests.

6. Right to Restriction of Processing: Under certain circumstances, you have the right to restrict the processing of your Personal Data. This may include situations where you contest the accuracy of your data or when the processing is unlawful.

7. Right to Lodge a Complaint: If you believe that Troopr's processing of your Personal Data infringes your rights under the GDPR, you have the right to lodge a complaint with the relevant data protection authority.
